Mediation

Almost everyone knows somebody who has had a dispute with their neighbour about one thing or another whether including noise nuisance, dogs barking and car repairs. To someone not directly involved in the dispute, the reason for the falling out can often appear trivial - but to those involved it can have a serious impact on their ability to enjoy their life at home.

Many disputes could be resolved early on if both parties were to talk about the problems, and try to agree a solution that suited everyone involved. Often conflict arises from a ‘clash of lifestyles’ and the other person may not even realise they are causing a nuisance.

What is mediation?
Mediation is a way of helping neighbours to discuss problems and reach a solution acceptable to everyone involved, without the need to go to court - which can be time consuming and costly.

Key points

  • Those in conflict, not the mediators, decide the terms of any agreement reached.
  • Mediators will explain the limits of confidentiality on your first visit.
  • Although mediation looks at the past, its focus is on the future i.e. how you want the situation to be from now on.
  • Mediation is more likely to get to the root of the problem, quite often one incident may have been the cause of a long running dispute.

How does it work?
The mediator will be a person that is not involved in the dispute and not known to the people involved. The mediator acts as a go-between to help the people involved come to a solution that they can agree on.

  • Mediation is free to all MHT London tenants and leaseholders.
  • Everything discussed with a mediator is kept private and confidential. No one is told anything unless it is with permission.
  • Mediators do not take sides in a dispute or decide who is right or wrong.
  • The Mediation Service is an independent organisation with no direct links with MHT London.

If you are experiencing a dispute with your neighbour, you should contact your Neighbourhood Officer to find out whether mediation may be able to help.
